Requirements for pyrotechnic products

In accordance with the General Fire Safety Requirements
for the maintenance and operation of capital buildings (structures), isolated premises and other facilities owned by business entities (approved by Decree of the President of the Republic of Belarus No. 7 dated 23.11.2017), the use of pyrotechnic products is not permitted in buildings, structures, and premises.

In accordance with fire safety rules for residential buildings, structures and facilities located on the adjacent territory, garden houses, utility buildings and structures located on a land plot, in buildings, utility buildings and structures, the following is not permitted:

use of pyrotechnic products, with the exception of pyrotechnic products corresponding to hazard class I
according to the technical regulation Customs Union 006/2011
"On the safety of pyrotechnic products"
, adopted by the Decision of the Commission of the Customs Union of August 16, 2011, No. 770.

The use of household pyrotechnic products of hazard classes II-III is permitted only outdoors and
in accordance with the requirements of operational documentation and technological instructions approved in the established manner.

Legal entities with a permit (license) for this type of activity in accordance with the requirements of the legislation of the Customs Union member state where the show (event) is held are allowed to conduct firework displays or other entertainment events involving the use of technical pyrotechnic products of hazard classes IV and V.

The firework performer shall notify the Department for Supervision of Safe Work Practices in Industry of the Ministry of Emergency Situations of the Republic of Belarus (hereinafter – Gospromnadzor) in writing about the conduct of a firework display using pyrotechnic products of hazard classes IV and V.

In accordance with the Law of the Republic of Belarus "On Mass Events in the Republic of Belarus" of December 30, 1997, No. 114-Z,
the application for a mass event to the local executive and administrative body, on whose territory the mass event is planned, shall specify information on the use of pyrotechnic products (type, quantity) and open fire, if the mass event will be held with their use.

In accordance with Article 3.30 of the Procedural-Executive Code of the Republic of Belarus on Administrative Offenses, state fire supervision bodies are not authorized to draw up protocols under Article 24.30 "Violation of rules for handling firearms, explosives, flammable, corrosive substances or pyrotechnic products".

In cases where the use of pyrotechnic products led
to a fire or ignition, the guilty person shall be
brought to administrative responsibility by state fire supervision bodies
(Article 24.36 of the Administrative Offenses Code of the Republic of Belarus).

 

Gospromnadzor Requirements

In accordance with paragraph 48 of the Rules for ensuring industrial safety in handling pyrotechnic products, approved by Resolution of the Ministry of Emergency Situations of the Republic of Belarus of January 4, 2021, No. 2 (hereinafter – the Rules), when organizing a firework display, the performer shall develop, taking into account the requirements of the Rules, a plan of measures
to ensure technical safety and fire protection.

All work on the arrangement and conduct of fireworks must be carried out in accordance with the requirements of Chapter 4 of the Rules.

Transportation of pyrotechnic products is carried out
in accordance with the requirements of the Rules for ensuring the safety of transportation of dangerous goods by road, approved by Resolution of the Ministry of Emergency Situations of the Republic of Belarus of May 17, 2021, No. 35.

When conducting fireworks, only pyrotechnic products that have a certificate of conformity with the requirements of TR CU 006/2011, and serviceable launching equipment that meets the requirements of the Rules and the manufacturer's operational documentation are allowed to be used.

When choosing (determining) the location for a firework display, the following safety requirements established by TR CU 006/2011 and the Rules for choosing a launch site must be taken into account:

1. The locations of launch sites are determined by the organizer of the firework display and the performer depending
on the technical characteristics of the pyrotechnic products used
and launching equipment, as well as weather conditions.

2. Launch sites, as a rule, are located on the shore of a reservoir; the place for spectators should be chosen so that it is on the windward side outside the dangerous zone.

3. Launch sites should not be located closer than two maximum radii of dangerous zones, established for pyrotechnic products used in firework displays,
from combustible buildings, fuel and other combustible material warehouses, warehouses (including stacks, haystacks) of combustible coarse fodder, fields
with ripening grain crops, post-harvest residues
and stubble, coniferous forest, power lines.

4. Firework displays are not permitted:

in places where it is not possible to ensure the safety requirements for the use of pyrotechnic products, provided for by the operational documentation for pyrotechnic products and these Rules;

in buildings, structures and premises;

in places where mass events are not permitted;

on bridges, overpasses, transport hubs, in the protection zone of railways, oil, gas and product pipelines and power lines;

on the territory of complexes and ensembles of cultural heritage monuments of architecture, archeology, history, reserves
and national parks, burial sites, religious buildings (structures), pilgrimage sites;

at a distance less than twice the maximum radius of the dangerous zone, established for the pyrotechnic products used,
from fire-hazardous, explosive and harmful industries and facilities.

Please note that when conducting fireworks, safe distances indicated in technical regulatory legal acts for pyrotechnic products must be observed, including
taking into account weather conditions, wind speed, launch angle of products
from launching equipment (mortars). It is not recommended to use pyrotechnic products in heavy rain, wind exceeding 15 m/s.

Sites from which fireworks are launched must be provided with primary fire extinguishing equipment.

When conducting mass events, in cases provided for by legislative acts, a combat crew of the fire and rescue service is organized at the firework display sites.

Security (cordon) of the dangerous zone is provided by the performer and (or) the organizer of the firework display.

 

Sale of pyrotechnic products

Resolution of the Council of Ministers of the Republic of Belarus
of July 22, 2014, No. 703 "On the sale of certain types of goods, the provision of public catering and the procedure for developing and approving the assortment list of goods" approved the Rules for the sale of certain types of goods and the provision of public catering. Chapter 13 of the Rules defines the procedure for the sale of household pyrotechnic products.

Hazard classes I and II – in stores, pavilions, kiosks, non-isolated retail outlets located in the retail area of stores, pavilions, areas of shopping centers;
