CHAPTER 4
SUBMISSION, REFUSAL TO ACCEPT AND WITHDRAWAL OF AN APPLICATION BY AN INTERESTED PERSON
Article 14. Application of an interested person
1. The application of an interested person shall be submitted in Belarusian and (or) Russian.
2. The application of an interested person shall be submitted in written form, except for cases when legislative acts and resolutions of the Council of Ministers of the Republic of Belarus allow the submission of an application in oral form.
Legislative acts and resolutions of the Council of Ministers of the Republic of Belarus, along with the submission of an application by an interested person in written or oral form, may provide for the possibility of submitting such an application in electronic form.
3. The application of an interested person in oral form shall be submitted during the reception of the interested person.
4. The application of an interested person in written form shall be submitted to the authorized body:
during the reception of the interested person;
by messenger (courier), by mail, if, in accordance with the legislation on administrative procedures, the personal presence of the interested person is not required.
5. If the legislation on administrative procedures does not define the information that must be contained in the application of an interested person submitted in written form, such an application must contain:
the name of the authorized body to which the application is submitted;
information about the interested person:
surname, first name, patronymic (if any), place of residence (place of stay) – for a citizen who is not an individual entrepreneur;
surname, first name, patronymic (if any), place of residence, registration number in the Unified State Register of Legal Entities and Individual Entrepreneurs, name of the state body, other state organization that carried out state registration – for an individual entrepreneur;
name and location, registration number in the Unified State Register of Legal Entities and Individual Entrepreneurs, name of the state body, other state organization that carried out state registration – for a legal entity;
the name of the administrative procedure for which the interested person applies;
a list of documents and (or) information (if any) submitted together with the application of the interested person;
information on the payment of fees charged during the implementation of administrative procedures, through the use of the automated information system of the unified settlement and information space (account number of the operation (transaction) in the unified settlement and information space or a mark of the payment made, if the indication of this number is not required to confirm the fact of payment) – in case of payment through the use of such a system;
signature of a citizen, or signature of the head of a legal entity or a person authorized to sign the application in the prescribed manner, or signature of a representative of the interested person.
Legislation on administrative procedures may provide for standard forms (blanks) of applications from interested parties for certain administrative procedures.
6. An application from an interested person in electronic form shall be submitted through the unified portal of electronic services after gaining access to it:
without using the identification means specified in the third and fourth paragraphs of this part;
using a unique identifier of the interested person (except when the interested person is a legal entity). The procedure for obtaining a unique identifier is established by the Council of Ministers of the Republic of Belarus;
using a personal electronic digital signature key, the certificate of the corresponding public key of which was issued by the republican certification center of the State System for Managing Public Keys for Verifying Electronic Digital Signatures of the Republic of Belarus.
The method of access to the unified portal of electronic services for submitting an application from an interested person in electronic form is determined by the Council of Ministers of the Republic of Belarus in the list of administrative procedures to be carried out electronically through the unified portal of electronic services.
7. If the legislation on administrative procedures does not specify the information that must be contained in an application from an interested person submitted in electronic form, such an application must contain the information specified in paragraphs two to nine of the first part of clause 5 of this article.
8. An application from an interested person submitted in electronic form shall be considered in the manner established by this Law for considering applications submitted in written form, taking into account the specifics provided for by this Law.
