Peculiarities of individuals sending medicines in international postal items
In connection with inquiries received by the Vitebsk Customs regarding the movement of medicines by individuals across the customs border of the Eurasian Economic Union (hereinafter – EAEU) by sending them in international postal items (hereinafter – IPOs), we inform the following.
The legislation of the EAEU and the Republic of Belarus permits the movement of medicines for personal use by individuals by sending them in IPOs, with the exception of the categories of medicines listed below.
Thus, when sending medicines in IPOs, it is necessary to take into account that the Law of the Republic of Belarus "On the Circulation of Medicines" prohibits the import into the territory of the Republic of Belarus of substandard, counterfeit medicines, as well as medicines with an expired shelf life.
In addition, it is prohibited to send in IPOs medicines that contain psychotropic or narcotic substances included in section 2.12 of Appendix 2 to Decision No. 30 of the Board of the Eurasian Economic Commission dated April 21, 2015, No. 30 "On Non-Tariff Regulation Measures," as well as in the republican list of narcotic drugs, psychotropic substances, and their precursors subject to state control in the Republic of Belarus.
A ban on sending medicines containing psychotropic or narcotic substances in IPOs is also established by the rules for providing postal services in the Republic of Belarus.
We draw attention to the fact that the movement across the customs border of the EAEU, including sending in IPOs, of prohibited medicines may entail administrative and/or criminal liability.
Thus, to avoid violations of the law when planning to send medicines in IPOs, we recommend checking in advance whether they contain psychotropic or narcotic substances prohibited for sending in IPOs.
Additionally, we recommend moving medicines in their original factory packaging to enable identification and determination of their composition.
