New Rules for Timber Sales in the Republic of Belarus

On November 8, Head of State Alexander Lukashenka signed Decree No. 504 "On Amending and Supplementing Decrees of the President of the Republic of Belarus dated May 7, 2007, No. 214 and September 9, 2009, No. 444".

The document clarifies certain provisions of the Rules for the Release of Standing Timber and its Harvesting in the Forests of the Republic of Belarus, the Regulations on the Procedure for Granting Forest Fund Plots to Legal Entities for Lease and/or Use for Forest Management, and also sets forth a new version of the Rules for the Sale of Timber on the domestic market of the republic.

In particular, the Rules introduce a norm stating that the Rules do not apply to objects of reconstruction of melioration systems and hydraulic structures, clarify terminology, simplify document processing in case of small-scale timber release by the forestry for firewood, and increase the volume of such timber to 15 cubic meters instead of the previously established norm of up to 10 cubic meters.

The existing legal gap in decision-making regarding the allocation of land plots for the creation of wild animal enclosures has been addressed by amendments to the Regulation.

In addition, the Regulation clarifies the procedure for interaction between the state body (organization) and the forest user and the legal entity managing the forest.

The new wording of the Rules for the Sale of Timber on the Domestic Market is due to the need to increase the efficiency of using commercial timber harvested in the country. The current system for selling standing timber has significant drawbacks, as its harvesting yields associated assortments that are not used in production.

In this regard, to transition to the sale of harvested timber, a norm is introduced for a gradual reduction in the volume of standing timber sold at exchange auctions from 50% of the felling area volume proportionally by species groups in 2013 (3.2 million cubic meters) to 25% in 2014 (1.7 million cubic meters), and from 2015, it is proposed to sell standing timber only from soft-leaved felling areas in hard-to-reach areas of the forest fund (0.8 million cubic meters).

This period will be sufficient for a gradual transition to the new timber sales procedure and the formation of a market for logging services.

This will achieve a uniform price level and equal conditions for the acquisition of harvested timber for all woodworking organizations, and will also ensure the development of the entire annual volume of available standing timber.

Due to the fact that the transition to the new mechanism may lead to an increase in harvesting costs by 10-15%, and considering that agricultural organizations independently harvest timber, the Decree, for the purpose of implementing state programs, provides for the allocation of standing timber from the funds of regional executive committees in an amount not exceeding 15% of the felling area volume of the Ministry of Forestry. To guarantee the possibility for the population, budgetary organizations, construction organizations, and agro-industrial complex organizations to acquire sawn timber, a part of the timber from the regional executive committee's fund will be distributed to woodworking enterprises of the Ministry of Forestry to partially load their woodworking capacities to achieve these goals.

Procedure for issuing standing and harvested firewood to the population

An order for small-scale release of standing timber (not more than 50 cubic meters) for all types of felling is issued by the forestry unit based on a logging ticket issued to it by the legal entity managing the forest. The location of the felling area where the firewood will be released is determined according to the forest management project and the production plan of the forestry unit, and not at the citizen's request.

In the case of small-scale release of standing timber by the forestry unit for clearing debris, felling dry, wind-felled, and storm-damaged trees in an amount up to 15 cubic meters of firewood, the citizen independently determines the location and accessibility of the aforementioned type of timber (excluding mature stands).

The citizen submits a written application to the forestry unit for the issuance of an order for the release of standing timber for firewood harvesting; within 10 days, the forester is obliged to issue this document. The order is valid for two months from the date of issue.

Upon receipt of the order, the citizen or their representative must familiarize themselves with the Rules for the Release of Standing Timber and the Forest Fire Safety Rules and sign in the line "I have read and undertake to comply with the Rules for the Release of Standing Timber in the Forests of the Republic of Belarus and the Forest Fire Safety Rules: Forest User".

After the citizen completes the firewood harvesting, an act of inspection of the quantity of harvested timber is drawn up, after which removal is permitted, and after removal, an act of inspection of the felling sites is drawn up.

Forest users who have received orders for timber harvesting ensure the protection of felling areas and the fulfillment of obligations stipulated by the Rules for the Release of Standing Timber.

Harvested firewood is sold upon oral request of citizens to the forestry, at prices approved by regional executive committees in accordance with pricing legislation.
