What items imported in one vehicle cannot be classified as goods for personal use?
The classification of goods moved by individuals across the customs border of the Eurasian Economic Union (hereinafter referred to as the EAEU) as goods for personal use is carried out by customs officials based on the results of customs control, taking into account:

1) the individual's declaration of goods moved across the EAEU customs border, either orally or in writing using a passenger customs declaration;

2) the nature and quantity of the goods;

3) the frequency of the individual crossing the EAEU customs border and/or moving goods across the EAEU customs border by that individual or addressed to them.

The State Customs Committee of the Republic of Belarus has developed methodological recommendations for determining the purpose of goods imported by individuals, which are available on the unified internet portal of the customs authorities of the Republic of Belarus (www.customs.gov.by, Home > Individuals > Methodological recommendations for determining the purpose of goods imported by individuals) (hereinafter referred to as the Methodological Recommendations).

In accordance with these Methodological Recommendations, when deciding on the purpose of goods, the assortment of goods moved by individuals in one vehicle is also taken into account.

Thus, identical building materials imported in one vehicle for personal use or in one international cargo transport vehicle (as accompanied baggage), as well as goods consisting of a single unit imported disassembled by various individuals, cannot be classified as goods for personal use.

Furthermore, goods specified in sub-paragraphs 1-2 of Appendix 2 of the Methodological Recommendations, in quantities of three or more units of the same name, belonging to different individuals who are not members of the same family, as well as goods specified in paragraph 1 of Appendix 2, imported in a disassembled state, and imported in one vehicle, cannot be classified as goods for personal use.

Please note that if the customs authority does not classify goods imported into the EAEU customs territory by an individual as goods for personal use, the release of such goods is carried out in accordance with the requirements established by customs legislation for legal entities and individual entrepreneurs, with such goods being placed under customs procedures and a goods declaration being used for customs declaration purposes.
